The Legal Framework
A complainant must prove: (i) the domain name is identical or confusingly similar to a trade mark in which the complainant has rights; (ii) the respondent has no rights or legitimate interests in the domain name; and (iii) the domain name was registered and is being used in bad faith.
Software is protected as a literary work under copyright law. Protection arises automatically on creation without registration, although COSOTA registration provides evidential advantages in enforcement proceedings.
