The Legal Framework
A person may be registered as a registered user of a trade mark, whether with or without conditions or restrictions. The Registrar shall, on application made in the prescribed manner by the registered proprietor of the trade mark and the proposed registered user, register the proposed registered user in respect of the goods or services in relation to which it is proposed that he shall be registered.
Unregistered licence agreements carry serious risks in enforcement proceedings. We ensure all licensing arrangements are properly documented and recorded with the relevant registrar so that rights are fully enforceable.
Key Facts
Exclusive: Only the licensee may use the right
Non-exclusive: Multiple licensees permitted
Sole: Licensor + one licensee only
Sub-licence: Licensee may grant further licences
IP as a Revenue Asset
A registered trademark or patent can generate royalty income even when you are not exploiting it yourself. We structure licence arrangements to maximise this value.
