Practice Area 03
Copyright & Neighbouring Rights
Copyright arises automatically upon creation — but knowing how to use, licence, and enforce it is where legal expertise transforms a right into a revenue stream.
What We Do
- ▸Voluntary copyright registration with COSOTA for evidential advantage
- ▸Drafting and negotiating copyright licences and assignments
- ▸Work-for-hire analysis — ensuring IP ownership vests in the commissioning party
- ▸Copyright clearance for digital content, platforms and publishers
- ▸Software and database IP protection strategies
- ▸Infringement analysis and takedown strategies (online and offline)
- ▸Civil enforcement before the High Court of Tanzania
- ▸Collecting society (COSOTA) liaison and distributions advisory
- ▸Moral rights advisory for creators
- ▸AI-generated content ownership analysis
The Legal Framework
Copyright shall subsist in every original literary, artistic or scientific work which has been created by a national or resident of Tanzania, or is first published in Tanzania, irrespective of the quality of the work.
Authors shall enjoy, in respect of works for which they are protected under this Convention, the rights which their respective laws do now or may hereafter grant to their nationals, as well as the rights specially granted by this Convention. Protection shall operate independently of the existence of protection in the country of origin of the work.

For Businesses
